MY EX SAYS CUSTODY IS AN ISSUE IF I GO AFTER SUPPORT

That is something that is frequently heard from clients who finally make a decision to seek legal help for child support matters. In another question here, we addressed the independence of custody and support issues. If there is a basis for taking custody, why do you think it wasn't pursued before money became an issue. Our superior court judges were not born yesterday, and timing and motive are legitimate questions they ask themselves.

Any attorney representing an adverse parent is going to advise the client to improve their position any legal way they can. Unfortunately, threatened persons sometimes use the kids to try to gain position. Your attorney knows what to do if they cross the line.

You will not lose custody because you filed an action to make things better for your children. What we do often see is non-custodial parents seeking joint legal custody as opposed to sole custody. There is nothing wrong with an otherwise fit person doing that, and it should not affect any rights that you have.
